PLEASE READ THE FOLLOWING TERMS OF SERVICE AGREEMENT CAREFULLY. BY ACCESSING OR USING OUR SITES AND OUR SERVICES, YOU HEREBY AGREE TO BE BOUND BY THE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IT IS THE RESPONSIBILITY OF YOU, THE USER, CUSTOMER, OR PROSPECTIVE CUSTOMER TO READ THE TERMS AND CONDITIONS BEFORE PROCEEDING TO USE THIS SITE. IF YOU DO NOT EXPRESSLY AGREE TO ALL OF THE TERMS AND CONDITIONS, THEN PLEASE DO NOT ACCESS OR USE OUR SITES OR OUR SERVICES. THIS TERMS OF SERVICE AGREEMENT IS EFFECTIVE AS OF 10/01/2019.

ACCEPTANCE OF TERMS

The following Terms of Service Agreement (the “TOS”) is a legally binding agreement that shall govern the relationship with our users and others which may interact or interface with For All My Boys, LLC, located at 1485 Howard Road, P.O. Box 64473, Rochester, New York 14624 and our subsidiaries and affiliates, in association with the use of the website, which includes TheEdgeWedge.com, (the “Site”) and its Services, which shall be defined below.

Sales and Refund Policy

Thanks for shopping at For All My Boys. We’d like to take an opportunity to explain our terms and conditions that apply to transactions at the For All My Boys website. By placing an order or making a purchase at the For All My Boys website, you agree to the terms set forth below.

Pricing and Price Reductions/Corrections

Only one coupon/discount can be applied at a time.

For All My Boys reserves the right to change prices for products displayed at/on the For All My Boys website at any time and to correct pricing errors that may inadvertently occur.

Order Acceptance/Confirmation

For All My Boys may, in its sole discretion, refuse or cancel any order and limit order quantity. For All My Boys may also require additional qualifying information prior to accepting or processing any order. Once we receive your Online order, we’ll provide you with an email order confirmation. Your receipt of an order confirmation, however, does not signify For All My Boys’s acceptance of your order, nor does it constitute confirmation of our offer to sell; we are simply confirming that we received your order. The For All My Boys website reserves the right at any time after receiving your order to accept or decline your order for any reason. If For All My Boys cancels an order after you have already been billed, For All My Boys will refund the billed amount.

Given the popularity and/or supply constraints of some of our products, For All My Boys may have to limit the number of products available for purchase. For All My Boys reserves the right to change quantities available for purchase at any time, even after you place an order.

All sales are final. Prices shown are in U.S. dollars. If you are paying for your order with an international Visa, MasterCard, or American Express credit card, please note that the purchase price may fluctuate with exchange rates. In addition, your bank or credit card issuer may also charge you foreign conversion charges and fees, which may also increase the overall cost of your purchase. Please contact your bank or credit card issuer regarding these fees.

Since the actual delivery of your order can be impacted by many events beyond For All My Boys’s control once it leaves our facilities, For All My Boys cannot be held liable for late deliveries. We will, however, work with you to ensure a smooth delivery.

Returns & Refunds Policy and Restocking Fee

If you complete a purchase and wish to cancel it, contact For All My Boys at Hi@TheEdgeWedge.com.

If your item has not yet been shipped, we will cancel the order and your full purchase price including shipping will be refunded.

All sales are final. No refunds will be given. We reserve the right to accept returns for refund and will charge a restocking fee of up to 25% of the purchase price paid, plus any applicable sales tax. This applies to canceled orders being processed and orders that have shipped. Refunds will only be issued to the original payment method that you use when placing your order. If you return a purchased item that qualified you for a discount, promotional item or promotional card (for example, discounts for bulk purchases) and either (i) do not also return the discounted or promotional item or (ii) have already redeemed the promotional card, For All My Boys may deduct the value of the discount, promotional item or redeemed card from any refund you receive for the return of the purchased item.

A 90-day warranty is provided starting from the shipping date.

All product returns require a Return Merchandise Authorization (RMA) number. Before returning a product, please, first contact For All My Boys customer service and obtain a Return Merchant Authorization (RMA) number before the end of the applicable return period. For All My Boys will not accept warranty/defective component returns without an RMA number. You may obtain an RMA number by contacting For All My Boys at Hi@TheEdgeWedge.com.

  • You must ship the product to For All My Boys within three ( 3 ) calendar days of the date that For All My Boys issues the warranty Return Merchant Authorization (RMA) and follow these steps:
  • Ship back all products you are seeking to return to For All My Boys and for which you received an RMA number.
  • For warranty returns, the item must be new, unaltered, undamaged and in its original packaging.
  • Ship the products at your expense and insure the shipment or accept the risk of loss or damage during shipment. We recommend that you ship return merchandise via Fedex with tracking, signature confirmation and that you request adequate insurance to cover the purchase price of the shipment. For All My Boys will not assume responsibility for reimbursement or compensation if return/exchange packages are damaged, lost, stolen, or mishandled. We highly recommend you using original packaging and pack the product the same way as it was originally shipped.

Damaged Shipping and System Failure Out of the Box

  • If you encounter any delivery issues, please contact For All My Boys Customer Service.
  • Locate your package as soon as possible.
  • If your package is missing, please check around your delivery location, and report any missing packages to our customer service department immediately.
  • Please inspect your package right way (open shipping/retail boxes to inspect their contents), before signing for the delivery.
  • Do not assume the item is undamaged because the packaging does not show signs of damage.
  • Do not sign for or accept delivery of any packages that are visibly damaged without first inspecting their contents.
  • If the delivery person does not allow you to inspect the merchandise, ask him or her to wait while you contact their office or customer service department.
  • If the merchandise appears to be damaged, please refuse delivery of the item and notify our customer service department immediately.
  • If you have signed for a shipment, and you subsequently find there to be damage that was concealed by the packaging, do not throw away the packing materials or cartons or there will be no basis for a claim to file on your behalf. Concealed damage is damage that occurred either at the factory or during shipment that is not obvious without removing the packaging. If you discover concealed damage, stop unwrapping or un-packaging the shipment and notify our customer service department immediately.

The same product that you ordered will be shipped to you at our expense. For All My Boys will cover shipping only for US based customers. For international customers the buyer will be responsible for actual return shipping charges. First, you have to ship damaged unit back. After receiving unit back, we will send you the replacement. Shipping will be arranged at our expense for all products determined by For All My Boys to be defective products.

Terms of Sale

These terms apply to all consumer purchases of For All My Boys products, software, services, or support.

Orders, Pricing, and Payments

For All My Boys strives to communicate accurate pricing and product information but will not be held responsible for any pricing, typographical, or other errors in such communications. Your order is subject to cancellation by For All My Boys in its sole discretion. Unless otherwise agreed to by For All My Boys, payment must be received by For All My Boys prior to our acceptance of an order. For All My Boys may process payment for and ship parts of an order separately.  For All My Boys is not responsible for any import taxes, customs duties or import duties on international orders.

Warranty terms

  1. A 90-day warranty is provided starting from the actual shipping date. You may obtain an RMA number by contacting For All My Boys at Hi@TheEdgeWedge.com.
  2. The warranty only applies to the original purchaser who purchased the product directly from For All My Boys.
  3. Defective products within warranty period can be repaired free of charge under the warranty policy.

Limitation of Liability

FOR ALL MY BOYS DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR PRODUCT NOT BEING AVAILABLE FOR USE, LOST PROFITS, LOSS OF BUSINESS OR FOR LOST OR CORRUPTED DATA OR SOFTWARE, OR THE PROVISION OF SERVICES AND SUPPORT. EXCEPT AS EXPRESSLY PROVIDED HEREIN, FOR ALL MY BOYS WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR FOR ANY CLAIM BY ANY THIRD PARTY.  YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCT, FOR ALL MY BOYS IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AMOUNT INVOICED FOR THE APPLICABLE PRODUCT. SOME JURISDICTIONS MAY NOT ENFORCE ALL OF THESE LIMITATIONS, AND ONLY THE LIMITATIONS THAT ARE LAWFULLY APPLIED TO YOU IN YOUR JURISDICTION WILL APPLY. 

Purchases may not be resold or exported

Your purchase is for your own use, not for resale or export. Your purchase may not be sold, leased, or transferred to restricted countries, restricted end users, or for restricted end uses according to U.S. export and sanctions laws. 

If you (or a freight forwarder you so designate) have a U.S. address, purchase goods from For All My Boys to be shipped to a U.S. location, and then subsequently export the goods, you or the designated freight forwarder are considered the exporter and are solely responsible for compliance with all export and import regulations, including all U.S. export regulations and the import regulations of the destination country. For All My Boys must not be listed on any export documentation (e.g., export declarations, invoices, packing lists, air waybills, etc.). It is your responsibility to ensure the freight forwarder’s most up-to-date U.S. address is used.

Governing Law

THE PARTIES AGREE THAT THIS AGREEMENT, ANY SALES THERE-UNDER, OR ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE) BETWEEN YOU AND FOR ALL MY BOYS ARISING FROM OR RELATING TO THIS AGREEMENT, ITS INTERPRETATION OR THE BREACH, TERMINATION OR VALIDITY THEREOF, THE RELATIONSHIPS WHICH RESULT FROM THIS AGREEMENT, COPERNICUS MINING’S ADVERTISING, OR ANY RELATED PURCHASE SHALL BE GOVERNED BY THE LAWS OF THE STATE OF NEW YORK, WITHOUT REGARD TO CONFLICTS OF LAW. 

Dispute Resolution and Binding Arbitration

YOU AND FOR ALL MY BOYS AND SUBSIDIARIES ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.

ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN CUSTOMER AND For All My Boys and its agents, employees, successors, assigns, direct and indirect subsidiaries, and any third party providing any products or services to you in connection with your purchase (collectively “Copernicus Mining”) arising from or relating in any way to your purchase of Product, this Agreement, its interpretation or the breach, termination or validity thereof, the relationships which result from this Agreement (including relationships with third parties who are not signatories to this Agreement), Copernicus Mining’s advertising or any related purchase SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION. The arbitrator shall have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision including any unconscionability challenge or any other challenge that the arbitration provision or the Agreement is void, voidable or otherwise invalid. The arbitration shall be administered by the American Arbitration Association (AAA) or JAMS (or a substitute forum if both are unavailable). Arbitration proceedings shall be governed by this provision and the applicable procedures of the selected arbitration administrator, including any applicable procedures for consumer-related disputes, in effect at the time the claim is filed. Consumer claimants (individuals whose transaction is intended for personal, family or household use) may elect to pursue their claims in small-claims court rather than arbitration. The arbitration or small-claims court proceeding will be limited solely to the customer’s individual dispute or controversy.

You agree to arbitration on an individual basis. In any dispute, NEITHER CUSTOMER NOR FOR ALL MY BOYS SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS, OR ARBITRATE OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. If any provision of this arbitration agreement is found unenforceable, the unenforceable provision shall be severed, and the remaining arbitration terms shall be enforced (but in no case shall there be a class arbitration).

Modifications for Terms and Conditions

For All My Boys may make changes to the Site and the Terms and Conditions. It is your responsibility to review the Terms and Conditions for updates or changes. If you do not agree with the Terms and Conditions, you should not use the Site.

International Buyers

Import duties, taxes and charges are not included in the item price or shipping charges. These charges are the buyer’s responsibility.

Any and all visitors to our site, despite whether they are registered or not, shall be deemed as “users” of the herein contained Services provided for the purpose of this TOS. Once an individual register’s for our Services, through the process of creating an account, the user shall then be considered a “member.”

The user and/or member acknowledges and agrees that the Services provided and made available through our website and applications, which may include some mobile applications and that those applications may be made available on various social media networking sites and numerous other platforms and downloadable programs, are the sole property of For All My Boys. At its discretion, For All My Boys may offer additional website Services and/or products, or update, modify or revise any current content and Services, and this Agreement shall apply to any and all additional Services and/or products and any and all updated, modified or revised Services unless otherwise stipulated. For All My Boys does hereby reserve the right to cancel and cease offering any of the aforementioned Services and/or products. You, as the end user and/or member, acknowledge, accept and agree that For All My Boys shall not be held liable for any such updates, modifications, revisions, suspensions or discontinuance of any of our Services and/or products. Your continued use of the Services provided, after such posting of any updates, changes, and/or modifications shall constitute your acceptance of such updates, changes and/or modifications, and as such, frequent review of this Agreement and any and all applicable terms and policies should be made by you to ensure you are aware of all terms and policies currently in effect. Should you not agree to the updated, revised or modified terms, you must stop using the provided Services forthwith.

Furthermore, the user and/or member understands, acknowledges and agrees that the Services offered shall be provided “AS IS” and as such For All My Boys shall not assume any responsibility or obligation for the timeliness, missed delivery, deletion and/or any failure to store user content, communication or personalization settings.

REGISTRATION

To register and become a “member” of the Site, you must be at least 18 years of age to enter into and form a legally binding contract. In addition, you must be in good standing and not an individual that has been previously barred from receiving Services under the laws and statutes of the United States or other applicable jurisdiction.

When you register, we may collect information such as your name, e-mail address, birth date, gender, mailing address, occupation, industry and personal interests. You can edit your account information at any time. Once you register with and sign into our Services, you are no longer anonymous to us.

Furthermore, the registering party hereby acknowledges, understands and agrees to:

  1. Furnish factual, correct, current and complete information with regards to yourself as may be requested by the data registration process, and
  2. Maintain and promptly update your registration and profile information in an effort to maintain accuracy and completeness at all times.

If anyone knowingly provides any information of a false, untrue, inaccurate or incomplete nature, For All My Boys will have sufficient grounds and rights to suspend or terminate the member in violation of this aspect of the Agreement, and as such refuse any and all current or future use of For All My Boys Services, or any portion thereof.

It is For All My Boys’ priority to ensure the safety and privacy of all its visitors, users and members, especially that of children. Therefore, it is for this reason that the parents of any child under the age of 13 that permit their child or children access to the website platform Services must create a “family” account, which will certify that the individual creating the “family” account is of 18 years of age and as such, the parent or legal guardian of any child or children registered under the “family” account. As the creator of the “family” account, s/he is thereby granting permission for his/her child or children to access the various Services provided, including, but not limited to, message boards, email, and/or instant messaging. It is the parent’s and/or legal guardian’s responsibility to determine whether any of the Services and/or content provided are age-appropriate for his/her child.

PRIVACY POLICY

Every member’s registration data and various other personal information are strictly protected by the For All My Boys Online Privacy Policy (see the full Privacy Policy at ). As a member, you herein consent to the collection and use of the information provided, including the transfer of information within the United States and/or other countries for storage, processing or use by For All My Boys and/or our subsidiaries and affiliates.

MEMBER ACCOUNT, USERNAME, PASSWORD AND SECURITY

When you set up an account, you are the sole authorized user of your account. You shall be responsible for maintaining the secrecy and confidentiality of your password and for all activities that transpire on or within your account. It is your responsibility for any act or omission of any user(s) that access your account information that, if undertaken by you, would be deemed a violation of the TOS. It shall be your responsibility to notify For All My Boys immediately if you notice any unauthorized access or use of your account or password or any other breach of security. For All My Boys shall not be held liable for any loss and/or damage arising from any failure to comply with this term and/or condition of the TOS.

CONDUCT

As a user or member of the Site, you herein acknowledge, understand and agree that all information, text, software, data, photographs, music, video, messages, tags or any other content, whether it is publicly or privately posted and/or transmitted, is the expressed sole responsibility of the individual from whom the content originated. In short, this means that you are solely responsible for any and all content posted, uploaded, emailed, transmitted or otherwise made available by way of the Services, and as such, we do not guarantee the accuracy, integrity or quality of such content. Furthermore, you herein agree not to make use of For All My Boys’ Services for the purpose of:

  • uploading, posting, emailing, transmitting, or otherwise making available any content that shall be deemed unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or invasive of another’s privacy or which is hateful, and/or racially, ethnically, or otherwise objectionable;
  • causing harm to minors in any manner whatsoever;
  • impersonating any individual or entity, including, but not limited to, any officials, forum leaders, guides or hosts or falsely stating or otherwise misrepresenting any affiliation with an individual or entity;
  • forging captions, headings or titles or otherwise offering any content that you personally have no right to pursuant to any law nor having any contractual or fiduciary relationship with;
  • uploading, posting, emailing, transmitting or otherwise offering any such content that may infringe upon any patent, copyright, trademark, or any other proprietary or intellectual rights of any other party;
  • uploading, posting, emailing, transmitting or otherwise offering any content that you do not personally have any right to offer pursuant to any law or in accordance with any contractual or fiduciary relationship;
  • uploading, posting, emailing, transmitting, or otherwise offering any unsolicited or unauthorized advertising, promotional flyers, “junk mail,” “spam,” or any other form of solicitation, except in any such areas that may have been designated for such purpose;
  • uploading, posting, emailing, transmitting, or otherwise offering any source that may contain a software virus or other computer code, any files and/or programs which have been designed to interfere, destroy and/or limit the operation of any computer software, hardware, or telecommunication equipment;
  • disrupting the normal flow of communication, or otherwise acting in any manner that would negatively affect other users’ ability to participate in any real time interactions;
  • interfering with or disrupting any For All My Boys Services, servers and/or networks that may be connected or related to our website, including, but not limited to, the use of any device software and/or routine to bypass the robot exclusion headers;
  • intentionally or unintentionally violating any local, state, federal, national or international law, including, but not limited to, rules, guidelines, and/or regulations decreed by the U.S. Securities and Exchange Commission, in addition to any rules of any nation or other securities exchange, that would include without limitation, the New York Stock Exchange, the American Stock Exchange, or the NASDAQ, and any regulations having the force of law;
  • providing informational support or resources, concealing and/or disguising the character, location, and or source to any organization delegated by the United States government as a “foreign terrorist organization” in accordance to Section 219 of the Immigration Nationality Act;
  • “stalking” or with the intent to otherwise harass another individual; and/or
  • collecting or storing of any personal data relating to any other member or user in connection with the prohibited conduct and/or activities which have been set forth in the aforementioned paragraphs.

For All My Boys herein reserves the right to pre-screen, refuse and/or delete any content currently available through our Services. In addition, we reserve the right to remove and/or delete any such content that would violate the TOS or which would otherwise be considered offensive to other visitors, users and/or members.

For All My Boys herein reserves the right to access, preserve and/or disclose member account information and/or content if it is requested to do so by law or in good faith belief that any such action is deemed reasonably necessary for:

  • compliance with any legal process
  • enforcement of the TOS
  • responding to any claim that therein contained content is in violation of the rights of any third party
  • responding to requests for customer service
  • protecting the rights, property or the personal safety of For All My Boys, its visitors, users and members, including the general public.

For All My Boys herein reserves the right to include the use of security components that may permit digital information or material to be protected, and that such use of information and/or material is subject to usage guidelines and regulations established by For All My Boys or any other content providers supplying content services to For All My Boys. You are hereby prohibited from making any attempt to override or circumvent any of the embedded usage rules in our Services. Furthermore, unauthorized reproduction, publication, distribution, or exhibition of any information or materials supplied by our Services, despite whether done so in whole or in part, is expressly prohibited.

CAUTIONS FOR GLOBAL USE AND EXPORT AND IMPORT COMPLIANCE

Due to the global nature of the internet, through the use of our network you hereby agree to comply with all local rules relating to online conduct and that which is considered acceptable Content. Uploading, posting and/or transferring of software, technology and other technical data may be subject to the export and import laws of the United States and possibly other countries. Through the use of our network, you thus agree to comply with all applicable export and import laws, statutes and regulations, including, but not limited to, the Export Administration Regulations (http://www.access.gpo.gov/bis/ear/ear_data.html), as well as the sanctions control program of the United States(http://www.treasury.gov/resource-center/sanctions/Programs/Pages/Programs.aspx). Furthermore, you state and pledge that you:

  1. are not on the list of prohibited individuals which may be identified on any government export exclusion report (http://www.bis.doc.gov/complianceandenforcement/liststocheck.htm) nor a member of any other government which may be part of an export-prohibited country identified in applicable export and import laws and regulations;
  2. agree not to transfer any software, technology or any other technical data through the use of our network Services to any export-prohibited country;
  3. agree not to use our website network Services for any military, nuclear, missile, chemical or biological weaponry end uses that would be a violation of the U.S. export laws; and
  4. agree not to post, transfer nor upload any software, technology or any other technical data which would be in violation of the U.S. or other applicable export and/or import laws.

CONTENT PLACED OR MADE AVAILABLE FOR COMPANY SERVICES

For All My Boys shall not lay claim to ownership of any content submitted by any visitor, member, or user, nor make such content available for inclusion on our website Services. Therefore, you hereby grant and allow for For All My Boys the below listed worldwide, royalty-free and non-exclusive licenses, as applicable:

  1. The content submitted or made available for inclusion on the publicly accessible areas of For All My Boys’ sites, the license provided to permit to use, distribute, reproduce, modify, adapt, publicly perform and/or publicly display said Content on our network Services is for the sole purpose of providing and promoting the specific area to which this content was placed and/or made available for viewing. This license shall be available so long as you are a member of For All My Boys’ sites, and shall terminate at such time when you elect to discontinue your membership.
  2. GENERAL INFORMATION

ENTIRE AGREEMENT

This TOS constitutes the entire agreement between you and For All My Boys and shall govern the use of our Services, superseding any prior version of this TOS between you and us with respect to For All My Boys Services. CHOICE OF LAW AND FORUM

STATUTE OF LIMITATIONS
